Gabrielle's current practice predominantly focuses on commercial litigation and fiduciary litigation involving trusts, probate, or business relationships. Since 1990, Gabrielle has enjoyed successfully representing clients in a wide variety of litigation matters spanning antitrust, adversary proceedings in bankruptcy, contract disputes, wrongful termination claims, fraud, and serious personal injuries.   Gabrielle is a committed advocate for her clients and counsels them with candor.

Fiduciary Litigation

  • Represented beneficiary in multi-million dollar suit against trustee for breach of fiduciary duties and embezzlement of trust assets.
  • Represented several minority shareholders in obtaining satisfactory resolution in action against company directors and officers for breach of fiduciary duties and shareholder oppression.
  • Represented principal in suit against agent for breach of fiduciary duties in sale of company.
  • Represented individual with power of attorney in suit filed by the executor of parent's estate for breach of fiduciary duties.

Commercial Litigation

  • Successfully defeated injunction sought against client in antitrust matter and resolved lawsuit on terms favorable to client.
  • Successful representation of investor in multi-million dollar securities fraud arbitration against well-known securities broker dealer.
  • Representation of investors in securities arbitration dispute against broker for unauthorized trading.
  • Member of defense team for multi-million dollar complex litigation between international companies involving claims for fraud in securitized commercial mortgage transactions.
  • Obtained first judicial opinion interpreting the rights and obligations of notification centers operating under the Texas One-Call Law (Tex. Util. Code § 251.001, et. seq.).
  • Defended contractor against multi-million dollar claim for lost profits in lawsuit brought by oil refinery asserting breach of contract and negligence claims.
  • Represented equipment supplier in obtaining favorable resolution of lawsuit against principal for guaranty of company debt.

Bankruptcy Litigation

  • Successfully represented creditor in trial of bankruptcy adversary proceeding to defeat debtor's attempt to claim key asset as exempt.
  • Defended company in bankruptcy adversary proceeding against claims for breach of a confidentiality agreement and alleged misappropriation of confidential and proprietary information.

Personal Injury Defense Representation

  • Secured dismissal without payment in multi-party lawsuit seeking $8 million dollar recovery for individual who sustained serious burn injuries to 60% of his body.
  • Defended client in obtaining favorable resolution to lawsuit seeking seven figure recovery for individual who sustained second and third degree burn injuries to 43% of his body.
  • Defended numerous small and mid-size employers against claims for wrongful termination, personal injury, and premises liability.
  • Defended interests of insurance carrier in mass tort lawsuit brought by plant workers against former employer alleging various injuries due to exposure to toxic substances.
  • Selected by London based insurance syndicates to oversee over 700 lawsuits in Texas, including rendering case evaluations, recommending damage reserves, developing and approving case strategies, and negotiating settlements to clients' satisfaction for matters ranging from premises liability to wrongful death and toxic tort lawsuits.
