Looper Reed Retrieves Another Domain Name for Client through UDRP Win
November 4, 2011 - Someone other than the Berkeley Eye Center had been using the domain name www.berkeleyecenter.com since 2003. When the local media reported prominent physician, Dr. Ralph Berkeley, was going to set up shop with that name, a cybersquatter claimed the domain name prior to the registration of Berkeley Eye Center's trademark. Concerned that it would never be able to obtain its first domain name of choice, Berkeley Eye Center settled on www.berkeleye.com as its domain. Looper Reed attorneys Travis Crabtree and Carol Wilhelm won a Uniform Domain Name Dispute Resolution ("UDRP") arbitration with the World Intellectual Property Organization to win back the name for the Houston-based medical practice despite the fact the original owner had owned the domain name since 2003 and it was claimed prior to Berkeley Eye Center's trademark registration. read more

By the performance bond, the surety promises to the government owner, as "obligee," that if the contractor, as "principal," defaults in its performance, the surety will either make good on the contractor's default or pay the resulting damages. Looper Reed Assists Government in Recovery of $16.25 Million Related to Bid Rigging at Texas Schools
November 11, 2010 - Looper Reed represented whistleblowers David Richardson, David Gills and Barry Clauss in their whistleblower claims related to bid rigging and imporper gift giving at Texas' two largest school districts, HISD and DISD related to E-Rate funds. On November 10, 2010, Hewlett Packard settled by agreeing to pay the federal government $16.25 million for their role in the scheme. Under the False Claims Act, also known as a qui tam suit, Looper Reed clients sued on behalf of the federal government after they discovered problems with the competitive bidding process at the two school districts in 2005. For their role in uncovering the graft and corruption, the clients will receive a portion of the recovery. The Federal Government has intervened in the suit and may continue to pursue claims against other defendants who were part of a consortium that caused the school districts to pay more for technology purchases than they otherwise should have. read more

Bayer Agrees to 'Watershed' Settlement in 7,000-Plaintiffs Rice Crop Contamination Litigation
October 21, 2010 - On Oct. 14, Bayer Crop Science finished the fourth day of a projected four-week bellwether trial in the 7,000-plaintiffs mass tort over its alleged contamination of the U.S. long-grain rice crop with an experimental strain of genetically modified rice. The case, involving a trio of Texas farmers (some of which were represented by Looper Reed & McGraw attorneys William Chaney and Drew York), was the last of four bellwether trials ordered by St. Louis federal district court judge Catherine Perry, who is overseeing the rice contamination multidistrict litigation. Each of the three preceding federal court bellwether trials, involving farmers from Missouri, Arkansas, Mississippi, and Louisiana, resulted in damages verdicts against Bayer of between $500,000 and $2 million. read more

His parents, Lanella Spinks Gray, BA '54, and the late Tom Gray, BBA '54, met at Baylor, and his mother hosts Baylor Line Camp freshmen each year at Independence, the site of Baylor's original campus. In many ways, the Grays are about as "Baylor" as a family can be. "I never imagined going to college anywhere else, and Baylor's always been part of my life," says Gray. March 22, 2010 - In February 2010, Jim Ormiston, head of LRM's litigation section, obtained a Final Judgment of over $1.7 million in an oil and gas class action case. The Final Judgment was rendered by a state court in Roswell, New Mexico, against Yates Petroleum Corporation, and followed a trial held in September 2009. The Class alleged, and the court found, that Yates failed to pay interest on proceeds held in suspense in violation of the New Mexico Oil & Gas Proceeds Payment Act. Thompson Comments on KTRH on Disney's Latest Crisis
August 20, 2009 - Walt Disney World in Orlando, had to cancel a stunt show on Tuesday, after an employee died during the practice. According to Associated Press, this is now the theme park’s third worker, that has been killed on the job this summer. Although Disney have said that the three deaths are not related in any way, and federal investigators are treating them as separate accidents. Disney spokeswoman Zoraya Suarez said, that they feel a sense of loss for their valued cast members. read more

William Chaney and Drew York successfully opposed Bayer AG
July 17, 2008 - William Chaney and Drew York successfully opposed Bayer AG's challenges to the Court's jurisdiction over it in the In re Genetically Modified Rice Litigation multidistrict litigation proceedings. Bayer AG sought dismissal alleging it had insufficient contacts in Missouri and the other rice growing states to allow the court to exercise jurisdiction over the company. Mr. Chaney, who serves on the Plaintiffs' Executive Committee in the MDL proceedings, and Mr. York spent one year conducting extensive jurisdictional discovery and filing briefs opposing Bayer AG's motion to dismiss, which culminated with Mr. Chaney's persuasive oral arguments before the court in May. The court denied Bayer AG's efforts to avoid jurisdiction and found that Bayer AG acted through one of its wholly-owned subsidiaries, Bayer CropScience AG, which had already conceded the court's jurisdiction. read more
CIMA ENERGY, Ltd become the exclusive gas marketing arm for Mitsubishi Corp
July 10, 2008 - After months of negotiations and planning, Looper Reed & McGraw attorney Don Looper as counsel helped CIMA ENERGY, Ltd become the exclusive gas marketing arm for Mitsubishi Corp for liquid natural gas brought to the Gulf Coast from Qatar. As part of the deal, Mitsubishi Corp purchased 34 percent of CIMA ENERGY to further Mitsubishi’s reach in the natural gas market. Thus, Mitsubishi will own a portion of CIMA's existing gas marketing network throughout the southern U.S, with offices in St. Louis, Denver and Kentucky. Mitsubishi made the acquisition through two U.S.-based subsidiaries, Mitsubishi International Corp and MC Global Gas Corp. Under the terms of the deal, Houston-based CIMA will market and sell natural gas from Mitsubishi's import operation at the Freeport LNG terminal. read more
The Statute of Frauds in Oil and Gas Transactions
April 12, 2007 - Since its inception the law of Texas has recognized that to promote the stability of landtitles and to avoid fraud in transactions involving land, such transactions should be in writing.For these reasons, the Texas Statute of Conveyances and Texas Statute of Frauds require thatconveyances and contracts for sale of real property be in writing and signed by the conveyor orparty to be charged. The test for sufficiency of a writing is essentially the same in both the Statute of Fraudsand the Statute of Conveyances.2 Thus, when referring to Texas statutes requiring that a contractconveying real property be in writing, for the sake of simplicity the courts refer generally to theStatute of Frauds. read more
